Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) describes prohibited uses and acceptable practices relating to the use of “Digitālās Ekonomikas Attīstības Centrs” Ltd, registration number 40003455216, legal and actual address: Čuibes street 17, Riga LV-1063 (hereinafter referred to as the “DEAC”, “us”, “our’') network, products, materials, online services, web page www.deac.eu, marketing platform, and any software that DEAC provides to Customer for download or use (the “Services”). The Services must be used in a way that complies with the intended purpose of the Services and the terms of our TOS, to which this AUP is incorporated by reference. DEAC may modify this policy at any time by posting a revised version. By using the Services, Customer consent to be bound by the terms of the latest version of this AUP. Terms not defined herein are defined in our TOS. Customer agrees to comply with this AUP. Customer also agrees to require Customers end-users to comply with this AUP. If Customer violates the AUP or authorizes, or helps others to do so (including Customers end Users), DEAC may suspend or terminate their use of the Services and delete Customers Account.”

1. ILLEGAL, HARMFUL OR OFFENSIVE USE OF CONTENT

Customer may not access, use, or authorize, or encourage or facilitate the use by others of the DEAC Services for any illegal, harmful or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful or offensive, such as defamatory, threatening, pornographic, abusive, libelous or otherwise objectionable material of any kind or nature, content containing any material that encourages conduct that could constitute a criminal offense, or that violates the intellectual property rights or rights to the publicity or privacy of others. Customers may not harass or interfere with another user’s full use and enjoyment of any part of the DEAC Services. Customers may not access or use the DEAC Services in a manner intended to improperly avoid incurring fees or exceeding usage or capacity limits.

2. NO SPAM, E-MAIL OR OTHER MESSAGE ABUSE

Customers may not distribute, publish, send, or facilitate the sending of unsolicited mass email or other messages, promotions, advertising, or solicitations (like “SPAM”), including commercial advertising and informational announcements. Customer will not alter or obscure mail headers or assume a sender’s identity without the sender’s explicit permission. Customer will not collect replies to messages sent from another internet service provider if those messages violate this AUP or the acceptable use policy of that provider.

3. SECURITY VIOLATIONS

Customers may not access or use the DEAC Services to violate the security, integrity or policies of any network, computer or communications system, or the DEAC or any other Software or application.

4. NETWORK ABUSE

Customers must not: damage, disable, overburden, or impair the DEAC Services (or any network connected to the DEAC Services), use any unauthorized means to modify, reroute, or gain access to the DEAC Service or attempt to carry out these activities. Customer will not store or transmit any content that contains or is used to initiate a denial of service attack, software viruses or other harmful or deleterious computer code, files or programs such as Trojan horses, worms, time bombs, cancelbots, or spyware.

5. MONITORING AND ENFORCEMENT

DEAC reserve the right to investigate any violation of this AUP or misuse of the Services. DEAC may investigate violations of this AUP or misuse of the Services, review any User Content, and remove, disable access to, or modify any content or resource (including User Content) that violates this AUP or any other agreement DEAC have with customers for use of the Services, monitor all prohibited actions, investigate, and/or take appropriate action at our sole discretion against Customer.

If Customer violate this AUP or any other provision of the TOS or otherwise create liability for us or any other person, including reputational harm, DEAC may (without limitation) and in addition to the above, terminate or suspend Customers Account, Customers access to any or all Services and the related services or any portion thereof at any time, with or without notice, for violating this AUP. DEAC may also take legal action to enforce our rights, and/or report Customer to appropriate law enforcement authorities, regulators, or other appropriate third parties.

Our reporting may include disclosing appropriate customer information. DEAC also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing information related to alleged violations of this AUP.

6. REPORTING OF VIOLATIONS OF THIS AUP

If Customer become aware of any violation of this AUP, Customer will immediately notify DEAC and provide us with assistance, as requested, to stop or remedy the violation. To report any violation of this AUP, please contact DEAC at [email protected]
